Respected Sir,
I would like to submit that: –
1. On 14.11.1998 I have been convicted for 07 years rigorous imprisonment and also convicted in three sections for two years and was sent to Jail. After conviction, the local Management have stopped my salary from 14.11.1998 vide letter No. ZAS/RHS/24039 dated 21.11.1998 “ You are, therefore, advised that his salary upto 13.11.1998 only be paid to him and from onward, salary should not be paid” subsequently my services have been terminated on 23.12.1998 with one month notice period. After termination, the Management vide letter No.ZAS/EA/163 dated 08.01.1999 directed the Branch of posting “You are advised to pay one month substantive pay in lieu of notice period i.e. 14.11.1998 to 14.12.1998”. This act shows the misdeed of the management at that time.
2. When the undersigned was reinstated back in the service of the Bank on 30.09.2002, the salary and back benefits were paid from 23.12.1998 too the benefits of the Circular effective from 01.01.1999 were not extended to the undersigned which is a clear immunity of the management with undersigned at that time that the honorable Supreme Court Order was not properly implemented and the undersigned was deprived from payment of huge amount on account of less payment of salary from 14.12.1998 to 23.12.1998 and nonpayment of salaries in accordance with Head Office Circular No. STF / 98 / 90 dated 30.12.1998, the act of the Management became an financial crime against the undersigned.
3. Since no response is given by the Bank since last couple of months, the applicant now no other alternative left but to knock the doors of honorable Supreme Court of Pakistan for implementation of judgment dated 10.09.2002.
4. Please take a notice that my Counsel has served a legal notice on your good self as well as Head HR for payment of differential of Salaries from 14.12.1998 till 23.12.1998 and payment of salaries from 01.01.1999 in accordance with Circular No. STF / 98 / 90 dated 30.12.1998.
5. That during 1996 my services were terminated vide letter No SAS/TM/SH/053491/1137 dated 23.12.1998 and reinstated in accordance with honorable Supreme Court of Pakistan Judgment dated 10.09.2002 and vide letter No. IH/TM/MZ/053491 dated 30.09.2002 applicant was reinstated by the Bank with all back benefits.
6. The applicant was paid Salaries from December 23, 1998 till 30.09.2002 but no details of salary paid have been furnished despite of repeated requests.

As per record, it seems that I have not been extended the benefits of the HOK Circular No. STF/98/90 dated 30.12.1998 whereby the Bank have revised the pay scales structure effective from 01.01.1999. At the time of termination from service of the Bank I was in OG I scale and at the time of termination from service my basic was Rs.9,600/-. As per revised scale structure applicable from 01.01.1999 the pay scale structure was to be fixed Rs.18,862.00 and as per Circular 10% increase was granted across the board of revised basic pay which comes to Rs.1,886.20, as such effective from 01.01.1999 my basic was to be fixed to Rs.20,528.20 whereas the applicant was reinstated back on the service of the Bank on 30.09.2002 thus, as per revised basic was to be applied along with due appraisals.

Applicant was granted performance appraisal for 2002, 2003, 2004 but there is no impact on my basic and as on 31.03.2005 and my basic pay shows Rs.21,360/- besides, payment of appraisals increases made in 2002, 2003, 2004 and 2005 which shows that despite of payment of appraisal increases in 2002, 2003 and 2004, there is no change in the applicants basic pay structure, which means that I have not been extended the salary increase in accordance with the revised pay structure despite of payment of appraisal in 2002, 2004. 2003 and 2004.

The basic pay as on 31.03.2005 i.e. Rs.21,360/- which is against the policy of HOK Circular No. STF/98/90 dated 30.12.1998 which needs to be revisited and need application of correct basic pay in accordance with the circular No. HR/98/90 dated 30.12.1998. The honorable Supreme Court reinstated the applicant with all back benefits i.e. from 23.12.1998, thus the Bank must apply appraisal increase from the date of termination from service of the Bank and re-fix the applicant’s salary in accordance with the Judgment of honorable Supreme Court till date of retirement i.e. 08.08.2016 strictly in the light of the circular No. STF/98/90 dated 30.12.1998 along with other benefits.
11 Further on persuasion of the record, it has been observed that on 11.03.1999, HBL Complex Branch, Quetta have transferred funds retained from 01.07.1998 to 31.10.1998 on account of PF, SBF and GIP amounting to Rs.10,145.68 covering period 01.07.1998 to 31.10.1998 in accordance with the instructions of HOK for credit into my provident fund account No. 16500 / others account, thus the benefits of provident fund and interest thereon could not be extended to the applicant effective from 01.07.1998 which need consideration for recalculation of the provident fund account in accordance with revised pay structure effective from the date of termination till date of retirement.
I will be grateful if your good offices may kindly provide me the details of salary increase for 1999 to 2002 – 2003 to 2005 and the basic pay fixed as on 01.01.1999. As per letter my basic as on 31.03.2005 is Rs.21,360/- which speaks itself that I have not be extended the salary increase in accordance with HOK Circular No. STF/98/90 dated 30.12.1998 as at that time I was behind the bars, as such no knowing the facts. Since I was paid salary errors in November 2002, as such is not aware about the fixation of basic pay.
